ORDINANCE NO. 0-6- 2008

AN ORDINANCE CLOSING AND VACATING KATH LOU COURT LOCATED IN THE CITY OF FT. THOMAS, CAMPBELL COUNTY, KENTUCKY.

NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNCIL OF THE CITY OF FORT THOMAS, KENTUCKY:

SECTION I

That the Board of Council of the City of Fort Thomas has determined that Kath Lou Court located within the City of Fort Thomas should be closed. The public way is more particularly described as follows:

Lying in the City of Fort Thomas, Campbell County, Kentucky and being a part of Kath Lou Court as shown on the recorded plat for Hunteman Tract (Plat Cabinet A, Slide 73B)more particularly described as follows:

Beginning at a set cross notch in the south right of way line of Hunteman Lane and the northwest right of way corner of Kath Lou Court (Plat Cabinet A, Slide 73B);Thence along the south line of Hunteman N 68°30=00@ E a distance of 40.10 feet to the northeast right of way corner Kath Lou Court; Thence along the east line of Kath Lou Court S 25°30=00@ E a distance of 175.00 feet to a point at the southeast right of way corner of Kath Lou Court; Thence with the south line of Kath Lou Court S 68°30=00@W a distance of 40.10 feet to a set 2@ steel rebar with identification cap stamped ASTUBBS KY 3834@ at the southwest right of way corner of Kath Lou Court; Thence with the west line of Kath Lou Court N 25°30=00@ W a distance of 175.00 feet to THE POINT OF BEGINNING.

See plat attached hereto and incorporated herein by reference and known as Exhibit A.

SECTION II

The City has determined that the owners of the property, which abuts Kath Lou Court are Barbara E. Vogel, a single woman, 20 Huntemann Lane, Ft. Thomas, Kentucky 41075; and, the City of Fort Thomas, 130 N. Ft. Thomas Avenue, Ft. Thomas, Campbell County, Kentucky 41075.

SECTION III

The City of Fort Thomas has provided written notice of the closing of Kath Lou Court to the property owners, Barbara E. Vogel and City of Fort Thomas. A Receipt of Notice has been signed by an abutting property owners and is attached hereto as Exhibit B. Barbara E. Vogel owns the real estate abutting Kath Lou Court by virtue of a deed recorded in Deed Book 581, page 327 of the Campbell County Clerk's office, Newport, Kentucky.

A Receipt of Notice has been signed by the City of Fort Thomas, an abutting property owner, and is attached hereto as Exhibit C. The City of Ft. Thomas owns real estate abutting Kath Lou Court by virtue of a deed recorded in Deed Book 590, page 541 of the Campbell County Clerk's office, Newport, Kentucky.

SECTION IV

The owner of property abutting Kath Lou Court; namely, Barbara E. Vogel, has given her written, notarized Consent to the closing of Kath Lou Court and a copy of the Consent is attached hereto, marked Exhibit B, and is incorporated herein by reference.

The owner of property abutting Kath Lou Court; namely, City of Fort Thomas, has given its written, notarized Consent to the closing of Kath Lou Court and a copy of the Consent is attached hereto, marked Exhibit C, and is incorporated herein by reference.

SECTION V

That Kath Lou Court described in SECTION I hereof is hereby declared closed without any further action pursuant to K.R.S. 82.405 (1) and (2).

SECTION VI

This ordinance shall be effective when read, passed and advertised according to law.
