AN ORDINANCE PROVIDING FOR AND ORDERING THE
STREETSCAPE IMPROVEMENT OF SOUTH FORT THOMAS AVENUE FROM 947 SOUTH FORT THOMAS
AVENUE TO ITS INTERSECTION WITH GARRISON AVENUE; AND RIVER ROAD FROM ITS
INTERSECTION WITH SOUTH FORT THOMAS AVENUE TO A POINT APPROXIMATELY 25 FEET IN
DISTANCE; ALL IN THE CITY OF FORT THOMAS, CAMPBELL COUNTY, KENTUCKY, AND ALL IN
ACCORDANCE WITH THE PLANS AND SPECIFICATIONS THERETO AS SUBMITTED BY THE CITY
ENGINEER AND AS APPROVED BY THE
BOARD OF COUNCIL OF THE CITY OF
FORT THOMAS; AND FURTHER, PROVIDING THAT THE ACTUAL COST OF THE CONSTRUCTION OF
SAID STREETSCAPE IMPROVEMENTS ARE TO BE BORNE BY THE CITY NINETY TWO AND
ONE-HALF PERCENT (92.5%) AND THE PROPERTY OWNER SEVEN AND ONE-HALF PERCENT
(7.5%); AND PROVIDING FOR THE PAYMENT OF AN IMPROVEMENT ASSESSMENT.
BE
IT ORDAINED BY THE CITY OF FORT THOMAS, CAMPBELL COUNTY, KENTUCKY:
SECTION I
That South Fort Thomas Avenue from 947 South Fort Thomas Avenue to its intersection with Garrison Avenue, be improved by removal of existing concrete curb, sidewalk and median, construction of new concrete vertical curb depressed at driveways, construction of new decorative sidewalk (combination of pavers and jointed plain concrete), limestone welcome mats at each property, interpretative pavers, construction of new ten-foot flush paver island, variable thickness asphalt pavement milling of 1.5” at centerline to 2.5” at face of curb, asphalt surfacing course of 1.5”, decorative street lighting, electrical outlets at tree wells and light poles, decorative street and regulatory signs, decorative paver crosswalks, tree wells with large trees, plantings of shrubs and perennials, and driveway alignment. The total preliminary cost estimate for these improvements are $863,000, with costs being shared on a 92.5/7.5 percent basis between the City and property owner. Using the front foot basis as the fair basis of assessment, the preliminary estimated cost to the property owner is $33.63 per front foot (f.f.). Please see the attached schedule listing property description, frontages, and anticipated costs.

That
consistent with a special improvement assessment policy approved by Council,
costs for the streetscape improvements shall be shared by the City and property
owner on a ninety two and one-half percent (92.5%) to the City and seven and
one-half percent (7.5%) to the property owner basis.
That the Board of Council shall advertise for bids in a newspaper of general bona fide circulation in the City of Fort Thomas prior to the day set for opening the bids for doing said work, said bids to be received by the City Administrative Officer at his office by the deadline date and time. Said publication shall occur not less than seven (7) days nor more than twenty-one (21) days before said date for opening bids. After said proposals are opened, they shall be transmitted to the Board of Council at their next regular meeting after proposals are received, and all proposals shall be made as required by the specifications thereof. A contract for the work shall be let to the lowest and best bidder; however, the Board of Council may reject all bids and re-advertise.
Upon
completion and acceptance of the work under the contract, the cost and expense
of same shall be ascertained, levied, assessed and apportioned to and against
the said lots or parts of lots and the owners thereof, according to the number
of front feet of the number of abutting feet of ground owned by each of
them. Due to the unique features of this
project, together with the fact that multi-year financing via borrowed funds is
the primary funding mechanism, the City will provide for special repayment
options for affected property owners.
All property owners shall have the option to finance the total amount of
their assessment invoice over a ten-year period, at a rate of interest
consistent with the tax-exempt borrowing rate secured by the City to finance
the project. This rate may be a fixed or
variable rate of interest. An
application form and $35.00 non-refundable administrative fee will be required
to exercise this repayment option.
Each
of the aforementioned streets shall constitute a separate and distinct
project. Any affected property owner
filing an action contesting the undertaking of the improvements shall only
relate to that streetscape project. The
City may proceed with all other streetscape improvement projects.
The
provisions of this Ordinance are severable.
If any provision, section, paragraph, or part thereof is held invalid,
such decision shall not affect or impair the validity of the remainder of this
Ordinance.
SECTION VIII
This Ordinance shall be in full
force and effect immediately upon passage.
