ORDINANCE NO. O-03-2009

 

AN ORDINANCE PROVIDING FOR AND ORDERING THE STREET IMPROVEMENT OF AUDUBON PLACE FROM ITS INTERSECTION WITH SOUTH FORT THOMAS AVENUE TO ITS INTERSECTION WITH ST. NICHOLAS PLACE; MANOR LANE FROM ITS INTERSECTION WITH SOUTH FORT THOMAS AVENUE TO ITS TERMINUS; MIDWAY COURT FROM ITS INTERSECTION WITH SOUTH FORT THOMAS AVENUE TO ITS TERMINUS; MONTVALE COURT FROM ITS INTERSECTION WITH SOUTH FORT THOMAS AVENUE TO ITS TERMINUS; NEWMAN AVENUE FROM ITS INTERSECTION WITH CHURCHILL DRIVE TO ITS INTERSECTION WITH KYLES LANE; WOODLAND PLACE FROM ITS INTERSECTION WITH HIGHLAND AVENUE TO ITS TERMINUS; AND SWEETBRIAR AVENUE FROM ITS INTERSECTION WITH HIGHLAND AVENUE TO ITS TERMINUS;  ALL IN THE CITY OF FORT THOMAS, CAMPBELL COUNTY, KENTUCKY, AND ALL IN ACCORD-ANCE WITH THE PLANS AND SPECIFICATIONS THEREOF AS SUBMITTED BY THE CITY ENGINEER, AND AS APPROVED BY THE BOARD OF COUNCIL OF THE CITY OF FORT THOMAS; AND FURTHER, PROVIDING THAT THE ACTUAL COST OF THE CONSTRUCTION OF SAID STREET IMPROVEMENTS ARE TO BE BORNE BY THE CITY FIFTY PERCENT (50%) AND THE PROPERTY OWNER FIFTY PERCENT (50%), AND PROVIDING FOR THE PAYMENT OF AN IMPROVEMENT ASSESSMENT.

 

BE IT ORDAINED BY THE CITY OF FORT THOMAS, CAMPBELL

COUNTY, KENTUCKY:

 

SECTION I

 

            That Audubon Place from its intersection with South Fort Thomas Avenue to its intersection with St. Nicholas Place be improved by performing spot curb repair for areas that have deteriorated, removing existing concrete sidewalk and constructing new 4” thick concrete walk, mudjacking as required to fill any voids or cavities underneath the pavement, full depth pavement repair as necessary, bituminous asphalt pavement surface milling, removing asphalt patches to original gutter line, asphalt leveling course of variable thickness (3/4" to 1") asphalt leveling to reconstruct the crown on the street as necessary, pavement fabric, asphalt resurfacing:  1-1/2" asphalt to be applied on top of the leveling course, raise manholes, and adjust downspouts that lead to the curb as necessary.  The total preliminary cost estimate for this improvement is $23,000 with costs being shared on a 50/50% basis between the City and property owner for those costs equivalent to standard street resurfacing with bituminous asphalt.  All additional costs associated with reconstruction shall be borne by the City.  Using the front foot basis as the fair basis of assessment, the preliminary estimated cost to the City and to the property owner is $8.84 per front foot (f.f.) for the 25’ wide section of street and $10.01 per front foot (f.f.) for the 28’ wide section of street. SECTION II

 

That Manor Lane from its intersection with South Fort Thomas Avenue to its terminus be improved by performing spot curb repair for areas that have deteriorated, removing existing concrete sidewalk and constructing new 4” thick concrete walk, mudjacking as required to fill any voids or cavities underneath the pavement, full depth pavement repair as necessary, bituminous asphalt pavement surface milling, removing asphalt patches to original gutter line, asphalt leveling course of variable thickness (3/4" to 1") asphalt leveling to reconstruct the crown on the street as necessary, pavement fabric, asphalt resurfacing:  1-1/2" asphalt to be applied on top of the leveling course, raise manholes, and adjust downspouts that lead to the curb as necessary.  The total preliminary cost estimate for this improvement is $34,800 with costs being shared on a 50/50% basis between the City and property owner for those costs equivalent to standard street resurfacing with bituminous asphalt.  All additional costs associated with reconstruction shall be borne by the City.  Using the front foot basis as the fair basis of assessment, the preliminary estimated cost to the City and to the property owner is $6.48 per front foot (f.f.) for the 20’ wide section of street and $9.33 per front foot (f.f.) for the 28’ wide section of street.                                                                                                             SECTION III

 

That Midway Court from its intersection with South Fort Thomas Avenue to its terminus be improved by performing spot curb repair for areas that have deteriorated, removing existing concrete sidewalk and constructing new 4” thick concrete walk, mudjacking as required to fill any voids or cavities underneath the pavement, full depth pavement repair as necessary, bituminous asphalt pavement surface milling, removing asphalt patches to original gutter line, asphalt leveling course of variable thickness (3/4" to 1") asphalt leveling to reconstruct the crown on the street as necessary, pavement fabric, asphalt resurfacing:  1-1/2" asphalt to be applied on top of the leveling course, raise manholes, and adjust downspouts that lead to the curb as necessary.  The total preliminary cost estimate for this improvement is $5,200 with costs being shared on a 50/50% basis between the City and property owner for those costs equivalent to standard street resurfacing with bituminous asphalt.  All additional costs associated with reconstruction shall be borne by the City.  Using the front foot basis as the fair basis of assessment, the preliminary estimated cost to the City and to the property owner is $5.61 per front foot (f.f.).                                                                                                             SECTION IV

 

That Montvale Court from its intersection with South Fort Thomas Avenue to its terminus be improved by performing spot curb repair for areas that have deteriorated, removing existing concrete sidewalk and constructing new 4” thick concrete walk, mudjacking as required to fill any voids or cavities underneath the pavement, full depth pavement repair as necessary, bituminous asphalt pavement surface milling, removing asphalt patches to original gutter line, asphalt leveling course of variable thickness (3/4" to 1") asphalt leveling to reconstruct the crown on the street as necessary, pavement fabric, asphalt resurfacing:  1-1/2" asphalt to be applied on top of the leveling course, raise manholes, and adjust downspouts that lead to the curb as necessary.  The total preliminary cost estimate for this improvement is $17,900 with costs being shared on a 50/50% basis between the City and property owner for those costs equivalent to standard street resurfacing with bituminous asphalt.  All additional costs associated with reconstruction shall be borne by the City.  Using the front foot basis as the fair basis of assessment, the preliminary estimated cost to the City and to the property owner is $6.73 per front foot (f.f.).                                                                                                             SECTION V

 

That Newman Avenue from its intersection with Churchill Drive to its intersection with Kyles Lane be improved by performing spot curb repair for areas that have deteriorated, removing existing concrete sidewalk and constructing new 4” thick concrete walk, mudjacking as required to fill any voids or cavities underneath the pavement, full depth pavement repair as necessary, bituminous asphalt pavement surface milling, removing asphalt patches to original gutter line, asphalt leveling course of variable thickness (3/4" to 1") asphalt leveling to reconstruct the crown on the street as necessary, pavement fabric, asphalt resurfacing:  1-1/2" asphalt to be applied on top of the leveling course, raise manholes, and adjust downspouts that lead to the curb as necessary.  The total preliminary cost estimate for this improvement is $69,700 with costs being shared on a 50/50% basis between the City and property owner for those costs equivalent to standard street resurfacing with bituminous asphalt.  All additional costs associated with reconstruction shall be borne by the City.  Using the front foot basis as the fair basis of assessment, the preliminary estimated cost to the City and to the property owner is $8.10 per front foot (f.f.).                                                                                                             SECTION VI

 

That Woodland Place from its intersection with Highland Avenue to its terminus be improved by performing spot curb repair for areas that have deteriorated, removing existing concrete sidewalk and constructing new 4” thick concrete walk, mudjacking as required to fill any voids or cavities underneath the pavement, full depth pavement repair as necessary, bituminous asphalt pavement surface milling, removing asphalt patches to original gutter line, asphalt leveling course of variable thickness (3/4" to 1") asphalt leveling to reconstruct the crown on the street as necessary, pavement fabric, asphalt resurfacing:  1-1/2" asphalt to be applied on top of the leveling course, raise manholes, and adjust downspouts that lead to the curb as necessary.  The total preliminary cost estimate for this improvement is $27,700 with costs being shared on a 50/50% basis between the City and property owner for those costs equivalent to standard street resurfacing with bituminous asphalt.  All additional costs associated with reconstruction shall be borne by the City.  Using the front foot basis as the fair basis of assessment, the preliminary estimated cost to the City and to the property owner is $9.50 per front foot (f.f.).                                                                                                             SECTION VII

 

That Sweetbriar Avenue from its intersection with Highland Avenue to its terminus be improved by removing existing concrete curb and constructing new vertical curb depressed at driveways with topsoil fill behind new curb, removing existing concrete sidewalk and constructing new 4” thick concrete walk, mudjacking as required to fill any voids or cavities underneath the pavement, full depth pavement repair as necessary, asphalt leveling course of variable thickness (3/4" to 1") asphalt leveling to reconstruct the crown on the street as necessary, asphalt resurfacing 1-1/4" asphalt to be applied on top of the leveling course, raise manholes, driveway alignment, and adjust downspouts that lead to the curb as necessary.  The total preliminary cost estimate for this improvement is $40,200 with costs being shared on a 50/50% basis between the City and property owner for those costs equivalent to standard street resurfacing with bituminous asphalt.  All additional costs associated with reconstruction shall be borne by the City.  Using the front foot basis as the fair basis of assessment, the preliminary estimated cost to the City and to the property owner is $9.75 per front foot (f.f.).                                                                                                             SECTION VIII

 

That consistent with City policy regarding improvements, costs for street improvements shall be shared by the City and property owner on a fifty percent (50%) to the City and fifty percent (50%) to the property owner basis for those costs equivalent to standard resurfacing with bituminous asphalt.  All additional costs associated with reconstruction shall be borne by the City.

 

                                                                                                            SECTION IX

 

That the Board of Council shall advertise for bids in a newspaper of general bona fide circulation in the City of Fort Thomas prior to the day set for opening the bids for doing said work, said bids to be received by the City Administrative Officer at his office.  Said publication shall occur not less than seven (7) days nor more than twenty-one (21) days before said date for opening bids.  After said proposals are opened, they shall be transmitted to the Board of Council at their next regular meeting after proposals are received, and all proposals shall be made as required by the specifications thereof.  A contract for the work shall be let to the lowest and best bidder; however, the Board of Council may reject all bids and readvertise.

 

                                                                                                            SECTION X

 

Upon completion and acceptance of the work under the contract, the cost and expense of same shall be ascertained, levied, assessed and apportioned to and against the said lots or parts of lots and the owners thereof, according to the number of front feet of the number of abutting feet of ground owned by each of them.

 

                                                                                                            SECTION XI

 

            This ordinance shall be in full force and effect from and after its passage, approval, and publication as required by law.
